Welcome to Coco. By accessing or using our platform, you agree to be bound by these Terms of Service. Please read them carefully before using our services.

1. Acceptance of Terms

By creating an account, linking an Instagram account, or using any part of the Coco platform, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these terms, you may not use our services.

2. Description of Service

Coco is a platform that enables users to create AI-powered character personas and deploy them on Instagram accounts. Our services include:

Character creation and configuration tools
AI-powered conversation capabilities through Instagram Direct Messages
Character management dashboard
Preview and testing features
Conversation monitoring tools

3. Account Registration

3.1 Eligibility

You must be at least 18 years old to use Coco. By registering, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms.

3.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

3.3 Accurate Information

You agree to provide accurate, current, and complete information during registration and to update such information as necessary.

4. Instagram Integration

4.1 Account Linking

By linking your Instagram account to Coco, you authorize us to access and interact with your Instagram account in accordance with the permissions granted during the OAuth process.

4.2 Compliance with Instagram Terms

You acknowledge that your use of Coco in connection with Instagram is subject to Instagram's Terms of Use and Community Guidelines. You are solely responsible for ensuring your character content and interactions comply with Instagram's policies.

4.3 Account Risks

You understand that using automation on Instagram may carry risks, including potential account restrictions or suspensions by Instagram. Coco is not responsible for any actions taken by Instagram against your accounts.

5. Character Content Guidelines

5.1 Acceptable Content

When creating characters, you agree to:

Create content that is lawful and does not violate any third-party rights
Clearly identify characters as AI-powered when asked by users
Not impersonate real individuals without authorization
Respect copyright and intellectual property rights

5.2 Prohibited Content

You may not create characters that:

Promote hate speech, harassment, or discrimination
Encourage violence or illegal activities
Contain sexually explicit content involving minors
Spread misinformation or engage in fraudulent activities
Violate any applicable laws or regulations

5.3 Copyright and IP

If you create characters based on copyrighted material (such as anime characters, movie characters, or celebrities), you acknowledge that you may be subject to claims by the rights holders. Coco does not endorse or authorize the creation of characters that infringe on intellectual property rights.

6. AI-Generated Content

You acknowledge that:

Character responses are generated by AI and may not always be accurate or appropriate
You are responsible for monitoring your character's conversations
AI-generated content does not represent the views of Coco
You should not rely on AI responses for medical, legal, or financial advice

7. User Responsibilities

As a user of Coco, you agree to:

Monitor your characters for inappropriate behavior
Respond promptly to reports of problematic content
Use the emergency stop feature when necessary
Comply with all applicable laws and regulations
Not abuse or attempt to manipulate our AI systems
Not use the service for spam or unauthorized commercial purposes

8. Content Moderation

Coco reserves the right to review, moderate, and remove any character or content that violates these Terms or our content policies. We may also suspend or terminate accounts that repeatedly violate our guidelines.

9. Intellectual Property

9.1 Coco's Rights

The Coco platform, including its design, features, and underlying technology, is the property of Coco and is protected by intellectual property laws.

9.2 Your Content

You retain ownership of the character configurations and content you create. By using Coco, you grant us a license to host, store, and display your content as necessary to provide our services.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

Coco is provided "as is" without warranties of any kind
We are not liable for any indirect, incidental, or consequential damages
We are not responsible for Instagram account suspensions or restrictions
We are not liable for AI-generated content or its consequences
Our total liability is limited to the amount you paid for our services

11. Indemnification

You agree to indemnify and hold harmless Coco, its officers, directors, employees, and agents from any claims, damages, or expenses arising from your use of the service, your character content, or your violation of these Terms.

12. Refund Policy

12.1 7 Days 7 Videos — Usage-Based Refund

For the "7 Days 7 Videos" one-time purchase ($69 for 7 videos), refunds are calculated on a usage-based, prorated basis:

Before any video is delivered: Full refund ($69)
After 1 video delivered: $59.10 refund (6 remaining × $9.90)
After 2 videos delivered: $49.50 refund (5 remaining × $9.90)
After 3 videos delivered: $39.60 refund (4 remaining × $9.90)
After 4 videos delivered: $29.70 refund (3 remaining × $9.90)
After 5 videos delivered: $19.80 refund (2 remaining × $9.90)
After 6 videos delivered: $9.90 refund (1 remaining × $9.90)
After all 7 videos delivered: No refund available

Refund amount = (7 − videos delivered) × $9.90. Refunds are processed within 5–10 business days to the original payment method.

12.2 Subscription Plans

For recurring subscription plans, you may cancel at any time. Cancellation takes effect at the end of the current billing period. No partial refunds are issued for unused days within a billing period.

12.3 How to Request a Refund

To request a refund, contact us at team@viralco.co with your order details. We will process your request promptly.

13. Termination

We may suspend or terminate your access to Coco at any time, with or without cause. Upon termination:

Your right to use the service ceases immediately
Your characters will be deactivated
You may request deletion of your data in accordance with our Privacy Policy

14. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by posting the new Terms on this page and updating the "Last Updated" date. Your continued use of Coco after changes constitutes acceptance of the updated Terms.

15. Governing Law

These Terms are governed by and construed in accordance with applicable laws. Any disputes arising from these Terms or your use of Coco will be resolved through binding arbitration or in the courts of competent jurisdiction.
